Negotiations Do Not Produce Legislation

"A broad coalition of business groups, builders, elected officials, and affordable housing advocates known as the Homeownership Opportunity Alliance (HOA) were negotiating with the trial bar and the Community Association Institute to try to reach agreement on construction defect litigation reform. Unfortunately these talks broke down this week and there will be no deal reached on meaningful construction defect reform this year that gives homeowners a voice in whether their most precious asset – their home – is tied up in long and costly litigation.

Some of the affordable housing legislation that was part of a package of bills is being introduced for consideration at the Capitol, which is detailed below in other bill descriptions. The HOA is disappointed that we could not come to agreement and that costly and protracted litigation will continue to affect the marketability of properties mired in lawsuits. The construction defects issue is a complex one, but the tools were available to provide a common sense solution that would address many of the flaws in the current system. The opportunity has been lost this session, but the HOA continues to represent a desire to see more affordable housing in Colorado become a reality."
